Division I. General Provisions

Chapter 1. Scope of Application

Article 1 Scope of regulation

The Code of Administrative Procedure governs:

1) the proceedings before competent public administration authorities in individual matters to be determined by way of administrative decisions or disposed of without notice by the authority;

2) the proceedings before other state authorities and other entities appointed to decide matters specified in subsection 1 by operation of law or on the basis of agreements;

3) the proceedings in matters involving disputes between authorities of units of self-government and government administration authorities over authority and competency and between those authorities and entities specified in subsection 2;

4) the proceedings in matters regarding the issuance of certificates;

5) the imposition or enforcement of administrative monetary penalties or the granting of relief in the enforcement of such penalties; and

6) the procedure for administrative cooperation in the European Union.

Article 2 Extension

The Code of Administrative Procedure also governs the proceedings regarding letters of dissatisfaction and proposals (Division VIII) before state authorities, authorities of units of self-government and before social organizations' bodies.

Article 3 Exclusion

§ 1. The provisions of the Code of Administrative Procedure shall not apply to:

1) proceedings in fiscal penal matters;

2) matters governed by the Act of 29 August 1997 - Tax Ordinance (Journal of Laws of 2017, items 201, 648, 768 and 935), except for Divisions IV, V and VIII.

§ 2. The provisions of the Code of Administrative Procedure shall also not apply to proceedings in matters:

1) (repealed);

2) (repealed);

3) (repealed);

4) for which Polish diplomatic representations and consular offices have competence,

unless specific provisions provide otherwise.

§ 3. The provisions of the Code of Administrative Procedure shall also not apply to proceedings in matters arising from:

1) organizational priority and subordination in relationships between state authorities and other state organizational units;

2) subordination of employees of authorities and organizational units specified in subsection 1.

unless specific provisions provide otherwise.

§ 4. However, provisions of Division VIII shall apply to proceedings in matters specified in § 1, 2 and 3 subsection 2.

§ 5. The Council of Ministers, by means of a regulation, may extend the applicability of all or part of the provisions of the Code of Administrative Procedure to the proceedings specified in § 2.

Article 4 Immunity

The Code of Administrative Procedure shall not infringe upon special privileges resulting from diplomatic and consular immunity and international treaties and customs.

Article 5 Definition

§ 1. If any provision of law generally invokes the provisions regarding the administrative proceedings, it shall be understood as to refer to the provisions of the Code of Administrative Procedure.

§ 2. Any reference in the provisions of the Code of Administrative Procedure to:

1) the Code - shall mean the Code of Administrative Procedure;

2) (repealed);

3) public administration authorities - shall mean ministers, central government administration authorities, voivodes and acting on behalf of the above authorities or on their own other local government administration authorities (combined and non-combined), authorities of units of self-government and authorities and entities specified in Article 1 subsection 2;

4) ministers - shall mean the Prime Minister and Deputy Prime Minister serving as ministers presiding over a specific division of government administration, ministers presiding over a specific division of government administration, heads of the committees in the Council of Ministers, heads of central offices of government administration subordinated, submitted or supervised by the Prime Minister or a relevant minister, as well as heads of other equivalent state offices authorized to dispose of the matters specified in Articles 1 subsections 1 and 4;

5) social organizations - shall mean professional, self-government and co-operative organizations as well as other social organizations;

6) authorities of units of self-government - shall mean the bodies of a municipality, poviat, voivodship, unions of municipalities, unions of poviats, wójt, mayor (city president), starost, marshall of voivodship, as well as the heads of services, inspections, guards and brigades operating on behalf of a wójt, mayor (city president), starost or marshall of voivodship, as well as self-government appeal boards.

Chapter 2. General Principles

Article 6 Principle of legality

Public administration authorities shall act on the basis of provisions of law.

Article 7 Principle of objective truth

In the course of the proceedings public administration authorities shall safeguard the rule of law and undertake, ex officio or upon application, any actions necessary to accurately clarify the facts of a matter and to dispose of the matter, taking into account the public interest and just interest of citizens.

Article 7a Principle of benefit of doubt as to the interpretation of legal norms

§ 1. If the object of the administrative proceedings is to impose an obligation on a party, to limit or to revoke a party's right in a matter where doubts remain as to the meaning of a legal norm, such doubts shall be resolved in favour of the party, unless it is rendered impossible due to conflicting interests of the parties or interests of third parties which are directly affected by the outcome of the proceedings.

§ 2. The provisions of § 1 shall not apply:

1) if important public interest, including essential state interest, and in particular interest relating to state security, defence or public order so requires; and

2) to personal matters of functionaries and professional soldiers.

Article 7b Principle of appropriateness, proportionality

Public administration authorities shall co-operate in the course of the proceedings in so far as it is necessary to fully clarify the facts and legal status of the matter, taking into account the public interest and just interest of citizens, as well as the efficient conduct of the proceedings by applying measures that are appropriate to the nature, circumstances and complexity of the matter.

Article 8 Principle of deepening trust

§ 1. Public administration authorities shall conduct the proceedings in such a manner as to deepen the trust of its participants in the public authorities, abiding by the principles of proportionality, impartiality and equal treatment.

§ 2. Without justified cause the public administration authorities shall not depart from the established practice of determination of matters of the same factual and legal status.

Article 9 Principle of furnishing information

Public administration authorities shall duly and fully inform the parties on factual and legal aspects which may influence the establishment of the parties' rights and duties being the object of the proceedings. The authorities shall safeguard the parties and other persons participating in the proceedings, so that neither the parties nor the persons suffer any damage due to their ignorance of law and to this end the authorities shall furnish the parties and persons with necessary explanations and guidelines.

Article 10 Principle of hearing of the parties

§ 1. Public administration authorities shall ensure that the parties may actively participate in every stage of the proceedings, and prior to issuing a decision the authorities shall give the parties an opportunity to present their position as to collected evidence and materials and submitted demands.

§ 2. Public administration authorities may depart from the principle specified in § 1 only if the matter must be decided without delay due to a threat to human life or health or due to threatening irreparable material damage.

§ 3. Public administration authorities shall, by way of annotation, enter in the records the reasons for departing from the principle specified in § 1.

Article 11 Explaining the grounds

Public administration authorities should explain to the parties the grounds for deciding the matter in order to, if possible, enable the parties to satisfy the decision without the application of any coercive measures.

Article 12 Principle of prompt and simple proceedings

§ 1. Public administration authorities shall act in a detailed and prompt manner, applying the simplest possible measures to dispose of the matter.

§ 2. Matters in which it is not necessary to collect evidence, information and explanations, shall be disposed of immediately.

Article 13 Principle of amicable resolution of disputed matters

§ 1. In matters which nature so permits, public administration authorities shall endeavour to amicably resolve disputed issues and to ascertain the rights and obligations being the object of the proceedings relating to matters for which they have competence, in particular by undertaking actions:

1) with a view to persuade the parties to reach a settlement, in matters involving parties of opposing interests; and

2) that are necessary to carry out mediation.

§ 2. Public administration authorities shall, at a given stage of the proceedings, undertake actions enabling to conduct mediation or settle the matter, and in particular they shall provide explanations as to the possibility and benefits of an amicable settlement of the matter.

Article 14 Principle of written proceedings

§ 1. All matters shall be disposed of in writing or in the form of an electronic document as defined in the Act of 17 February 2005 on Digitalisation of Operations of Entities Performing Public Tasks (Journal of Laws of 2017, item 570), to be served by means of electronic communication.

§ 2. Matters may be disposed of orally, if it is in the interest of the parties and no provision of law provides otherwise. The contents and essential reasons for such verbal disposal shall be entered in the records by way of minutes or annotation signed by the party.

Article 15 Principle of two-instance proceedings

Administrative proceedings shall be two levels of instances, unless specific provision provides otherwise.

Article 16 Principle of durability of an administrative decision

§ 1. Decisions which are not appealable in the administrative course of instance or which are not subject to review shall be final. Such decisions may be quashed, amended, declared invalid or the proceedings may be reopened only in instances provided for in the Code or separate statutes.

§ 2. Claims may be filed with an administrative court on grounds of violation of law, on terms and according to procedures specified in separate statutes.

§ 3. Final decisions that are not appealable to the court shall be legally binding.

Chapter 3. Authorities of Higher Level and Supreme Authorities

Article 17 Definitions

The following entities are authorities of higher level within the meaning of the Code:

1) with regard to authorities of units of self-government - self-government appeal boards, unless separate statutes provide otherwise;

2) with regard to voivodes - ministers competent for the matter;

3) with regard to public administration authorities other than those specified in subsections 1 and 2 - appropriate superior authorities or competent ministers, and if there are none - state authorities supervising their activity;

4) with regard to bodies of social organizations - appropriate bodies of higher level of such organizations, and if there are none - the state authority supervising their activity.

Article 18 Definition

The following entities are supreme authorities within the meaning of the Code:

1) with regard to government administration authorities, authorities of units of self-government except for self-government appeal boards, state authorities and self-government organizational units - the Prime Minister or competent ministers;

2) with regard to state authorities other than those specified in subsection 1 - relevant authorities having nationwide scope of operation;

3) with regard to bodies of social organizations - supreme bodies of the organizations, and if there are none - the Prime Minister or competent ministers exercising supreme supervision over their activity.

Chapter 4. Jurisdiction of Authorities

Article 19 Observance of jurisdiction

Public administration authorities shall observe ex officio their substantive and territorial jurisdiction.

Article 20 The subject-matter

The subject-matter jurisdiction of a public administration authority shall be determined according to the provisions governing the authority's scope of operation.

Article 21 Territorial jurisdiction

§ 1. Territorial jurisdiction of a public administration authority shall be determined:

1) with regard to matters concerning real property - according to its place of location; and if the real property is located in the territory falling under the jurisdiction of two or more authorities, the authority in which territory the greater part of the real property is located shall be competent to decide the matter;

2) with regard to matters concerning the operation of an employing establishment - according to the place where the employing establishment is, was or is to be operated;

3) in other matters - according to the domicile (registered office) in the country, and in case of lack thereof - according to the place of residence of the party or one of the parties; if neither of the parties is domiciled (has a registered office) in the country nor neither of them has a place of residence in the country - according to their last domicile (registered office) or residence in the country.

§ 2. If the territorial jurisdiction cannot be determined according to the rules described in § 1 above, the matter shall be disposed of by an authority having jurisdiction over the location where the incident giving rise to the proceedings occurred; and if such location has not been determined - by an authority having jurisdiction over Śródmieście district in the Capital City of Warsaw.

Article 22 Jurisdiction of authorities

§ 1. Jurisdiction disputes shall be resolved by:

1) in case of a dispute between authorities of units of self-government, except for cases specified in subsections 2-4 - a common authority of higher level, and in matters there is none - an administrative court;

2) in case of a dispute between the heads of services, inspections, guards and brigades of combined administration of the same poviat, operating on their own behalf or on behalf of the starost - the starost;

3) in case of a dispute between authorities of combined administration in one of voivodships, not specified in subsection 2 - the voivode;

4) in case of a dispute between the authorities of units of self-government in different voivodships in matters pertaining to the government administration - the minister responsible for public administration matters;

5) (repealed);

6) in case of a dispute between voivodes and combined administration authorities in different voivodships - the minister responsible for public administration matters;

7) in case of a dispute between a voivode and non-combined administration authorities - the minister responsible for public administration matters after consulting the authority supervising the authority being in dispute with the voivode;

8) in case of a dispute between public administration authorities other than those listed in subsections 1-4, 6 and 7 - common authority of higher level, and if there is none - the minister responsible for public administration matters; and

9) in case of a dispute between public administration authorities if one of the authorities is a minister - the Prime Minister.

§ 2. Disputes between authorities of units of self-government and government administration authorities regarding the scope of their powers shall be resolved by an administrative court.

§ 3. The application to have the dispute resolved by the administrative court may be submitted by:

1) the party;

2) an authority of the unit of self-government or other public administration authority being in dispute;

3) the minister responsible for public administration matters;

4) the minister responsible for justice, the General Public Prosecutor;

5) the Ombudsman.

Article 23 Actions of the authority

Until the jurisdiction dispute has been resolved, the public administration authority in which territory the matter arose, shall undertake only those actions which are to be performed without delay due to the public interest or just interest of citizens and it shall notify thereof the authority competent to resolve the dispute.

Chapter 5. Disqualification of an Employee and an Authority

Article 24 Grounds for disqualification of an employee

§ 1. An employee of a public administration authority shall be disqualified from participation in the proceedings in a matter:

1) to which he is a party or, if as a result of a legal relationship existing between him and one of the parties the outcome of the matter may affect his rights and duties;

2) concerning his spouse, relative or relative by affinity up to the second degree;

3) concerning a person in an adoptive, wardship or guardianship relation with him;

4) in which he was a witness or expert or in which he is or has served as a representative of one of the parties, or in which a party is represented by any of the persons listed in subsections 2 and 3;

5) in which he participated in the issuance of the challenged decision;

6) due to which an official investigation, disciplinary proceedings or criminal proceedings have been instituted against him;

7) in which one of the parties is his official superior.

§ 2. Dissolution of marriage (§ 1 subsection 2), adoption, wardship or guardianship (§ 1 subsection 3) shall not constitute grounds for disqualification of an employee from participating in the proceedings.

§ 3. At the request of the employee or of a party or acting ex officio, a direct superior of the employee shall disqualify himself from participating in the proceedings if it is probable that grounds exist which have not been listed in § 1 and which may cast doubt as to the impartiality of the employee.

§ 4. The disqualified employee should undertake only those actions which should be taken without delay due to the public interest or important interests of the parties.

Article 25 Grounds for disqualification of an authority

§ 1. A public administration authority shall be disqualified from deciding a matter concerning the financial interest of:

1) the head of the authority or persons being with him in relations specified in Article 24 § 1 subsections 2 and 3;

2) the head of an authority of directly higher level or persons with whom he is related as defined in Article 24 § 1 subsections 2 and 3.

§ 2. Article 24 § 4 applies mutatis mutandis.

Article 26 Designation of an employee or authority

§ 1. In case of a disqualification of an employee (Article 24), his direct superior shall designate another employee to dispose of the matter.

§ 2. In case of a disqualification of an authority, the matter shall be disposed of:

1) in instances specified in Article 25 § 1 subsection 1 - by the authority of higher level over the authority disposing the matter;

2) in instances specified in Article 25 § 1 subsection 2 - by the authority of higher level over the authority headed by the person specified in that provision.

The authority of higher level may designate another subordinate authority to dispose of the matter. If the person specified in Article 25 § 1 subsection 2 is a minister or a president of the self-government appeal board, the Prime Minister shall designate the authority competent to dispose of the matter.

§ 3. If due to the disqualification of employees of a public administration authority, the authority became incapable to dispose of the matter, the provisions of § 2 apply mutatis mutandis.

Article 27 Member of a collective authority

§ 1. A member of a collective authority shall be disqualified in instances specified in Article 24 § 1. In instances specified in Article 24 § 3, the member shall be disqualified by the president of the collective authority or the authority of higher level, acting upon the application of a party or of a member of the collective authority or ex officio.

§ 1a. A member of the self-government appeal board shall be disqualified from proceedings in a matter brought upon an application to reconsider the matter if the member was involved in the issuance of a decision specified in the application.

§ 2. If as a result of the disqualification of the members of a collective authority, the authority became incapable of adopting a resolution due to the lack of the required quorum, Article 26 § 2 applies mutatis mutandis.

§ 3. If as a result of the disqualification of its members, a self-government appeal board became incapable of deciding the matter, the minister responsible for public administration matters, by means of an order, shall designate another self-government appeal board to dispose of the matter.

Article 27a (repealed)

Chapter 6. A Party

Article 28 Definition

Each person whose legal interest or duty the proceedings concern or who requests the authority's action due to his legal interest or duty, shall be a party.

Article 29 Definition

Only natural and legal persons may enjoy the status of a party, and with regard to state and self-government organizational units and social organizations - also entities not having the status of a legal person.

Article 30 Reference

§ 1. Legal capacity and the capacity to enter into legal transactions shall be determined according to the provisions of civil law, unless specific provisions provide otherwise.

§ 2. Natural persons with no capacity to enter into legal transactions shall act through their legal representatives.

§ 3. Parties not being natural persons shall act through their legal or statutory representatives.

§ 4. In matters concerning transferable or hereditable rights, in case of a transfer of the right or death of the party during the pendency of the proceedings the legal successors of the party shall join the proceedings in lieu of the party.

§ 5. In case of inheritances which have not been taken over, the persons administering the assets of the inheritance estate shall act as a party, and if there are none - a guardian appointed by court upon an application of a public administration authority.

Article 31 Rights

§ 1. In matters concerning another person, a social organization may demand:

1) that the proceedings be initiated;

2) that the organization be allowed to participate in the proceedings,

if such a demand is justified by the statutory goals of the organization and public interest.

§ 1a. The social organisation referred to in § 1 may participate in the proceedings on behalf and for an employee sent for assignment to the territory of the Republic of Poland or therefrom, or on behalf or for an employer of an employee sent for assignment to the territory of the Republic of Poland or therefrom - upon consent of the party on behalf of and for whom the social organization acts in the proceedings.

§ 2. If a public administration authority considers such demand of a social organization as justified, the authority shall order initiation of the proceedings ex officio or to allow the social organization to participate in the proceedings. The order refusing to initiate the proceedings or to allow the social organization to participate in the proceedings shall be subject to complaint.

§ 3. The social organization participates in the proceedings as a party.

§ 4. Upon initiation of the proceedings in a matter concerning another person, the public administration authority shall notify thereof a social organization, if in the authority's opinion the organization may be interested in the participation in the proceedings due to its statutory goals and if it is justified by public interest.

§ 5. A social organization which does not participate in the proceedings as a party, may, upon the consent of the public administration authority, present to the authority its opinion pertaining to the matter, expressed in a resolution or a statement of its statutory body.

§ 6. (repealed)

Article 32 Appointment of an attorney-in-fact

A party may act through an attorney-in-fact, unless the nature of the action requires that it be taken by the party personally.

Article 33 Grounds and procedure

§ 1. Any natural person having capacity to enter into legal transactions may be an attorney-in-fact.

§ 2. The power of attorney shall be granted in writing in the form of an electronic document or submitted to the minutes.

§ 2a. The power of attorney in the form of an electronic document shall bear a qualified electronic signature or a signature confirmed by a trusted ePUAP profile.

§ 3. The attorney-in-fact shall submit the original copy or an officially certified copy of the power of attorney which shall be entered in the records. The attorney-at-law, legal counsel, patent agent or tax advisor may himself certify the copy of the power of attorney granted to him and copies of other documents evidencing his authorization. In case of doubts the public administration authority may demand that the party's signature be officially certified.

§ 3a. If a copy of the power of attorney or copies of other documents evidencing authorization have been made in the form of an electronic document, the certification, as specified in § 3, shall be effected by means of a qualified electronic signature or a signature confirmed by a trusted ePUAP profile affixed to such copies. The copies of the power of attorney or the copies of the other documents evidencing authorization which have been certified electronically shall be prepared in data formats specified in the provisions enacted under Article 18 subsection 1 of the Act of 17 February 2005 on Computerisation of Operations of Entities Performing Public Tasks.

§ 4. In minor matters, the public administration authority may elect not to demand the power of attorney if a member of the closest family or a person residing with the party is an attorney-in-fact and there are no doubts as to the existence and scope of the authorization to act on behalf of the party.

Article 34 Appointment of a representative

§ 1. A public administration authority shall apply to the court to designate a representative for an absent or incapacitated person, unless such a representative has already been appointed.

§ 2. If an action is to be taken immediately, the public administration authority shall appoint a representative for an absent person, who shall be authorized to act in the proceedings until an appropriate representative has been appointed by the court.

Chapter 7. Disposing the Matters

Article 35 Timeframe

§ 1. Public administration authorities shall dispose of matters without unnecessary delay.

§ 2. All matters which may be disposed of on the basis of evidence presented by a party together with the demand to initiate proceedings or on the basis of facts and evidence publicly known ex officio to the authority before which the proceedings have been pending or which may be established on the basis of data kept by the authority, shall be decided immediately.

§ 3. If it is necessary to conduct explanatory proceedings in the matter, the matter shall be decided no later than within one month, and if the matter is especially complex - no later than within two months of the day the proceedings have been initiated, and in the appellate proceedings - within one month of the day the appeal has been received.

§ 3a. Under simplified proceedings the matter shall be disposed of immediately, no later than within one month of the date when the proceedings were initiated.

§ 4. Specific provisions may set out other time limits than those specified in § 3 and § 3a.

§ 5. Time limits specified by law in relation to the performance of specific actions, periods of stay of the proceedings, the period of mediation, as well as delays for which the party is responsible or for reasons not attributable to the authority shall extend accordingly the time limits prescribed by the preceding provisions.

Article 36 Time limit exceeded

§ 1. The public administration authority shall notify the parties whenever it fails to dispose of the matter within the time limit specified, providing the reasons of delay and appointing a new time limit for the disposition of the matter, as well as instruct the parties of their right to submit a reminder notice.

§ 2. The same duty shall also be imposed upon the public administration authority, if the delay in disposing the matter has been caused by reasons not attributable to the authority.

Article 37 Right to submit a reminder notice

§ 1. The party may submit a reminder notice, if:

1) the matter has not been disposed of within the time limit under Article 35 or specific provisions and within the time limit specified pursuant to Article 36 § 1 (inaction); or

2) the proceedings have been conducted for a longer time than is necessary to dispose of the matter (excessively lengthy proceedings).

§ 2. A reminder notice shall be reasoned.

§ 3. The reminder notice shall be submitted:

1) to the authority of higher level via the authority conducting the proceedings; or

2) to the authority conducting the proceedings - if no authority of higher level exists.

§ 4. The authority conducting the proceedings shall forward the reminder notice to the authority of higher level without undue delay, no later than within 7 days of the date the reminder notice was received. The reminder notice shall be forwarded together with relevant copies of the records. Copies may be drawn up in the form of an electronic document. The authority forwarding the reminder notice shall take a position thereon.

§ 5. The authority referred to in § 3 shall consider the reminder notice within 7 days of receipt thereof.

§ 6. The authority considering the reminder notice shall issue an order which:

1) states whether the authority hearing the matter is responsible for inaction or excessive length of the proceedings and, if so, whether it constituted a gross violation of law; or

2) in case inaction or excessive lengthiness has been ascertained:

a) it shall obligate the authority hearing the matter to dispose thereof by appointing a time limit for the disposal of the matter, if the proceedings have not been concluded; and

b) it shall demand that the reasons be clarified and persons responsible for inaction or excessive length of the proceedings be established, and where necessary, the authority shall take measures preventing inaction or excessive length of the proceedings in the future.

§ 7. The authority considering the reminder notice may ex officio amend the order referred to in § 6 by extending the time limit for the completion of the proceedings, if new factual circumstances material to the matter or new evidence come to light that require longer proceedings, of which the authority was not aware at the time of appointing the time limit.

§ 8. In the case referred to in § 3 subsection 2, the provisions of § 4, 6 and 7 do not apply. In case inaction or excessive length of the proceedings have been ascertained, the authority conducting the proceedings shall dispose of the matter immediately and order that the reasons be clarified and persons responsible for inaction or excessive length of the proceedings be established, and where necessary, the authority shall take measures preventing inaction or excessive length of the proceedings in the future.

Article 38 Liability of an employee

An employee who without justified reasons has not disposed of the matter in a timely manner or conducted the proceedings longer than it was necessary to dispose of the matter shall be subject to liability for failure to obey work rules or disciplinary liability or other type of liability as provided by law.

Chapter 8. Service

Article 39 Manners of service

A public administration authority shall serve documents by postal operator as defined in the Act of 23 November 2012 - Postal Law (Journal of Laws of 2016, items 1113, 1250, 1823 and 1948) with return receipt requested, through its employees or through other authorized persons or bodies.

Article 391 Service by means of electronic communication

§ 1. Service of documents shall be effected by means of electronic communication within the meaning of Article 2 subsection 5 of the Act of 18 July 2002 on Provision of Services by Electronic Means (Journal of Laws of 2016, items 1030 and 1579), if a party to or other participant in the proceedings shall satisfy one of the following conditions:

1) he submits the application in the form of an electronic document via the electronic registry box of the public administration authority;

2) he applies to the public administration authority for such service and provides the authority with his email address; or

3) he consents for documents in the proceedings to be served by such means and provides the authority with his email address.

§ 1a. The public administration authority may request that a party to or other participant in the proceedings expresses his consent for documents to be served in the electronic form prescribed in other categories of individual matters specified and disposed of by this authority.

§ 1b. The public administration authority may apply for the consent specified in § 1 subsection 3 or § 1a by sending a relevant request by means of electronic communication to a party to or other participant in the proceedings to his email address.

§ 1c. Article 46 § 3-8 shall not apply to the application referred to in § 1b.

§ 1d. If the party to or other participant in the proceedings excludes service of documents by means of electronic communication, the public administration authority shall serve documents in a manner specified for documents in another form than the form of an electronic document.

§ 2. (repealed)

Article 392 Service via the electronic registry box

If a party to the proceedings or another participant in the proceedings is a public entity which is obligated to provide and maintain an electronic registry box in accordance with Article 16 paragraph 1a of the Act of 17 February 2005 on Computerisation of Operations of Entities Performing Public Tasks, service shall be made via the electronic registry box of such entity. The provisions of Article 391 do not apply.

Article 40 Status of an attorney-in-fact

§ 1. The documents shall be served on the party, and if the party acts through its representative - on the representative.

§ 2. If the party had appointed an attorney-in-fact, the documents shall be served upon the attorney-in-fact. If several attorneys-in-fact were appointed, the documents shall be served only upon one of them. The party shall have a right to indicate such an attorney.

§ 3. In a matter initiated upon an application filed by two or more parties, the documents shall be served upon all of the parties, unless in the application the parties indicated one of them as authorized to receive documents.

§ 4. A party who does not have his place of stay or residence or registered office in the Republic of Poland or another Member State of the European Union and who has not appointed an attorney-in-fact domiciled in the Republic of Poland and who does not act through the consul of the Republic of Poland, shall appoint an attorney-in-fact for service in the Republic of Poland, unless service is effected by means of electronic communication.

§ 5. In case an attorney-in-fact for service has not been designated, documents for this party shall be entered in the records and deemed duly served. The party shall be instructed thereon upon first service. The party shall be also instructed on his right to submit an answer to the document initiating the proceedings and an explanation in writing, as well as on who can be appointed as attorney-in-fact.

Article 41 Change of address

§ 1. During the course of the proceedings the parties and their representatives and attorneys-in-fact shall notify the public administration authority of any change of address, including email address.

§ 2. In case of failure to satisfy the obligation specified in § 1, service of documents to the original address shall be legally effective.

Article 42 Location

§ 1. With regard to natural persons, documents shall be served to their residence or workplace.

§ 2. Documents may also be served in the premises of the public administration authority, unless specific provisions provide otherwise.

§ 3. If it is impossible to serve documents in a manner specified in § 1 and § 2, or if needed, the documents may be served in any place where the addressee has been located.

Article 43 Absence of the addressee

If the addressee is absent the document may be served, with return receipt signed, on an adult person residing with the addressee, a neighbour or the property manager, provided that the persons undertake to deliver the document to the addressee. The addressee shall be notified that the documents have been served upon the neighbour or property manager by way of a notice placed in his mailbox, or - if that is not possible - on the entry door to the residence.

Article 44 Substitute service

§ 1. If it is not possible to serve documents in a manner specified in Articles 42 and 43:

1) if the documents are to be served by postal operator - the document shall be kept by the postal operator as defined in the Act of 23 November 2012 - Postal Law in its post office for a period of 14 days;,

2) if the documents are to be served by an employee of a municipal (city) office or authorized person or body - the document shall be kept in the office of a relevant municipality (city) for a period of 14 days.

§ 2. A notice that the document has been stored, including instructions describing how to collect it within 7 days of it being left in the location specified in § 1 shall be placed in the addressee's mailbox, and if that is not possible - on the entry door to his residence, his office or other premises at which the addressee performs his professional activity, or in a visible location at the entry gate to the addressee's premises.

§ 3. In the case the addressee fails to collect the document within the timeframe specified in § 2, another notice shall be left specifying the manner in which the document may be collected within the period not exceeding 14 days of the original notification.

§ 4. Service shall be deemed effected upon the lapse of the last day of the period specified in § 1, and the document shall be entered in the records.

Article 45 Service to the registered office

Organizational units and social organizations shall be served by delivering the document to their registered office premises; the document shall be served on the persons authorized to receive them. Article 44 applies mutatis mutandis.

Article 46 Confirmation of receipt

§ 1. Any person collecting the document shall confirm that the document has been served on him by signing and indicating the date of service.

§ 2. If the person collecting the document avoids confirming receipt or is unable to do so, the person serving the document may himself indicate the date of service and the person who collected the document and the reasons for the lack of the signature.

§ 3. If the document is to be served by means of electronic communication, the service shall be deemed effected when the addressee confirms receipt of the document as specified in § 4 subsection 3.

§ 4. In order to serve a document in electronic form, the public administration authority shall send to the electronic address of the addressee a notice containing:

1) an indication that the addressee may receive the document in electronic form,

2) an indication of an electronic address which may be used by the addressee to download the document and confirm its receipt,

3) an instruction in relation to the manner of receipt of the document, in particular the manner of identification at the indicated electronic address in the ICT system of the public administration authority and information concerning the requirement to sign the official confirmation of receipt as specified.

§ 5. If the document has not been received in electronic form as specified in § 4 subsection 3, the public administration authority shall, after 7 days of the day of the notice was sent, send another notice to enable the receipt of the document.

§ 6. If the document has not been received, service shall be deemed effective upon the expiry of 14 days of the date when the first notice was sent.

§ 7. The notice specified in § 4 and 5 may be automatically created and sent via the ICT system of the public administration authority, and receipt of such notice shall not be confirmed.

§ 8. If a document in the electronic form prescribed has been deemed collected on the basis of § 6, the public administration authority shall allow the addressee to access the content of the electronic document for a period of at least 3 months of the date when the electronic document was deemed collected and to information in the ICT system regarding the date when the document was deemed collected and dates when notices specified in § 4 and 5 were sent.

§ 9. Technical and organizational conditions of service of documents in electronic form are set out in the act referred to in § 4 subsection 3.

§ 10. Service of a document in the electronic form on the public entity within the meaning of the provisions of the act referred to in § 4 subsection 3 shall be effected via the electronic registry box of the entity in the manner specified in this act.

Article 47 Refusal to accept

§ 1. If the addressee refuses to accept the document sent to him by postal operator as defined in the Act of 23 November 2012 - Postal Law or other authority or in any other manner, the document shall be returned to the sender with an annotation of the refusal and the date thereof. The document together with the annotation shall be entered in the records.

§ 2. In cases specified in § 1 service shall be deemed effected on the day the addressee refused to accept the document.

Article 48 Service on the representative

§ 1. Documents addressed to persons of unknown whereabouts for which the court did not appoint any representative shall be served on the representative appointed on the basis of Article 34.

§ 2. Documents addressed to persons enjoying specific privileges resulting from diplomatic or consular immunity shall be served in a manner provided for in specific provisions of law, international treaties and norms.

Article 49 Public announcement

§ 1. If permitted under a specific provision, the parties may be given notice of decisions or other actions undertaken by the public administration authority by way of a public announcement, in another form of public notice customarily accepted in the given location or in a document made available in the Public Information Bulletin, on the own website of the competent public administration authority.

§ 2. The announcement, the public notice or the Public Information Bulletin shall state the date when the public announcement, another public notice was made or when the document was made available in the Public Information Bulletin. The notification shall be deemed effected after 14 days of the date when the public announcement, the public notice was made or when the document was made available in the Public Information Bulletin.

Article 49a Continued

Except for cases referred to in Article 49, the authority may give notice of decisions or other actions thereof in the form specified in Article 49 § 1, if there are more than twenty parties to the proceedings. Unless a specific provision provides otherwise, in such case, the notice shall have effect upon the parties, provided that they have been advised in advance and in writing on the intended manner of giving notice. Article 49 § 2 shall apply to giving notice.

Article 49b Manner, form in which the certified copy of the decision or order is made available

§ 1. In case a party is given notice, pursuant to Article 49 § 1 or Article 49a, of a decision or order which is subject to appeal, upon application of the party, the authority which issued the decision or order shall immediately, no later than within 3 days of receiving the application, provide the party with a certified copy of the decision or order in the manner and form specified in the application, unless the certified copy of the decision or order cannot be provided in such manner or in such form due to insufficient technical means of the authority.

§ 2. In case the decision or order referred to in § 1 cannot be provided to the party in the manner or form specified in the application, the authority shall notify the party thereof and indicate the manner or form in which the certified copy of the decision or order may be provided immediately.

Chapter 9. Summons

Article 50 Purpose of summons

§ 1. A public administration authority may summon persons to participate in the actions undertaken and to give explanations and testimony personally, through an attorney-in-fact, in writing or in the form of an electronic document, if it is necessary to decide the matter or perform official actions.

§ 2. The authority shall ensure that compliance with the summons would not be burdensome.

§ 3. If the summoned person cannot appear due to illness, disability, or other obstacle impossible to overcome, the authority may perform the action or hear explanations or testimony of the person summoned in the person's place of residence, provided that the circumstances surrounding the person allow.

Article 51 Appearance in person

§ 1. A person summoned has a duty to appear in person only within the limits of the municipality or city in which the person resides or stays.

§ 2. The duty to appear in person also applies to a person summoned who resides or stays within the limits of an adjacent municipality or city.

Article 52 Legal assistance

In the course of the proceedings the public administration authority may request from the competent local government administration authority or authority of unit of self-government to summon a person residing or staying in the given municipality or city to give explanations or testimony or to perform another action connected with the pending proceedings. The authority conducting the proceedings shall indicate circumstances to be provided in the explanations or testimony or actions to be performed.

Article 53 Exemptions

Articles 51 and 52 shall not apply, if the nature of the matter or action requires that the action be performed before the public administration authority conducting the proceedings.

Article 54 Contents of the summons

§ 1. In the summons the following shall be indicated:

1) name and address of the summoning authority;

2) forename and surname of the summoned person;

3) in what matter, capacity and to what purpose the person is summoned;

4) whether the summoned person should appear in person or through his attorney-in-fact or whether he may submit explanations or testimony in writing or in the form of an electronic document;

5) date by which the summons should be met or day, time and venue where the summoned person or his attorney-in-fact shall appear; and

6) legal consequences of failure to meet the summons.

§ 2. The signature of the employee of the summoning authority shall be affixed to the summons, with indication of the forename, surname and official position of the employee, or - if the summons is issued in electronic form - the summons shall bear a qualified electronic signature.

Article 55 Summons in specific form

§ 1. In cases of the utmost urgency a person may be summoned by telegraph or telephone or by any other means of communication; the data listed in Article 54 § 1 and the forename, surname and official position of the authority's employee shall be indicated in such summons.

§ 2. The summons effected in a manner specified in § 1 shall be legally effective only when no doubts exist that the summons has reached the addressee with appropriate contents and within the appropriate timeframe.

Article 56 Costs of appearance

§ 1. The person who appeared in response to the summons shall be reimbursed his travelling expenses and other expenses specified under the provisions of Section 2 Title III of the Act of 28 July 2005 on Court Costs in Civil Cases (Journal of Laws of 2016, item 623 and of 2017, item 85). The preceding sentence also applies to the costs connected with the appearance in person of the parties when the proceedings have been initiated ex officio or where the party without his fault has been mistakenly summoned to appear.

§ 2. The demand to award the amounts shall be made to the public administration authority before whom the proceedings have been pending and before the issuance of a decision, otherwise the claim shall expire.

Chapter 10. Time Limits

Article 57 Calculation

§ 1. If a time limit specified in days shall begin to run upon a certain event, the day on which the event occurred shall not count for the calculation of the time limit. The end of the last day of the prescribed number of days shall be the end of the time limit.

§ 2. Time limits specified in weeks shall end on such day of the last week whose name corresponds to the name of the initial day of the time limit.

§ 3. Time limits specified in months shall end on such day of the last month which corresponds to the initial day of the time limit, and if there is no such day of the last month - on the last day of such month.

§ 3a. Time limits specified in years shall end on such day of the last year which corresponds to the initial day of the time limit, and if there is no such day of the last year - on the day immediately preceding such day.

§ 4. If the end of the time limit for the performance of a given action falls on a public holiday, or on a Saturday, the next succeeding business day, which is not a public holiday and a Saturday, shall be deemed the last day of the time limit.

§ 5. The time limit shall be deemed to have been observed, if before the end of the time limit the document has been:

1) sent in electronic form to the public administration authority and the sender received the official confirmation of receipt;

2) dispatched at a Polish post office of a designated postal operator within the meaning of the Act of 23 November 2012 - Postal Law;

3) submitted to the Polish consular office;

4) submitted by a serviceman to the headquarters of a military unit;

5) submitted by a member of maritime vessel's crew to the captain of the vessel; or

6) submitted by a person deprived of liberty to the administration of the penal institution.

Article 58 Resetting a time limit

§ 1. In case of a failure to observe a time limit, upon the request of the interested person, the time limit shall be reset, if the interested person substantiates that the failure to observe the time limit was not attributable to his fault.

§ 2. The request to reset a time limit should be submitted within 7 days of the date the reason for failure to observe the time limit ceased to exist. Upon submission of the request the action for the performance of which the time limit has been appointed should be performed.

§ 3. It is inadmissible to reset the time limit for submitting the request specified in § 2.

Article 59 Competent authority

§ 1. The public administration authority competent to dispose of the matter shall decide whether the time limit should be reset. The order on the refusal to reset the time limit shall be subject to complaint.

§ 2. The authority competent to consider an appeal or complaint shall finally decide whether the time limit for filing the appeal or complaint should be reset.

Article 60 Stay of enforcement

Prior to considering the request to reset the time limit for filing an appeal or complaint the competent public administration authority, acting upon the request of a party, may stay the enforcement of the decision or order.

Rozdział 1. Zakres obowiązywania

Artykuł 1 Zakres regulacji

Kodeks postępowania administracyjnego normuje:

1) postępowanie przed organami administracji publicznej w należących do właściwości tych organów sprawach indywidualnych rozstrzyganych w drodze decyzji administracyjnych albo załatwianych milcząco;

2) postępowanie przed innymi organami państwowymi oraz przed innymi podmiotami, gdy są one powołane z mocy prawa lub na podstawie porozumień do załatwiania spraw określonych w pkt 1;

3) postępowanie w sprawach rozstrzygania sporów o właściwość między organami jednostek samorządu terytorialnego i organami administracji rządowej oraz między organami i podmiotami, o których mowa w pkt 2;

4) postępowanie w sprawach wydawania zaświadczeń;

5) nakładanie lub wymierzanie administracyjnych kar pieniężnych lub udzielanie ulg w ich wykonaniu;

6) tryb europejskiej współpracy administracyjnej.

Artykuł 2 Rozszerzenie

Kodeks postępowania administracyjnego normuje ponadto postępowanie w sprawie skarg i wniosków (Dział VIII) przed organami państwowymi, organami jednostek samorządu terytorialnego oraz przed organami organizacji społecznych.

Artykuł 3 Wyłączenia

§ 1. Przepisów Kodeksu postępowania administracyjnego nie stosuje się do:

1) postępowania w sprawach karnych skarbowych;

2) spraw uregulowanych w ustawie z dnia 29 sierpnia 1997 r. - Ordynacja podatkowa (Dz.U. z 2017 r. poz. 201, 648, 768 i 935), z wyjątkiem przepisów działów IV, V i VIII.

§ 2. Przepisów Kodeksu postępowania administracyjnego nie stosuje się również do postępowania w sprawach:

1) (uchylony)

2) (uchylony)

3) (uchylony)

4) należących do właściwości polskich przedstawicielstw dyplomatycznych i urzędów konsularnych,

o ile przepisy szczególne nie stanowią inaczej.

§ 3. Przepisów Kodeksu postępowania administracyjnego nie stosuje się także do postępowania w sprawach wynikających z:

1) nadrzędności i podległości organizacyjnej w stosunkach między organami państwowymi i innymi państwowymi jednostkami organizacyjnymi,

2) podległości służbowej pracowników organów i jednostek organizacyjnych wymienionych w pkt 1,

o ile przepisy szczególne nie stanowią inaczej.

§ 4. Do postępowania w sprawach wymienionych w § 1, 2 i 3 pkt 2 stosuje się jednak przepisy działu VIII.

§ 5. Rada Ministrów w drodze rozporządzenia może rozciągnąć przepisy Kodeksu postępowania administracyjnego w całości lub w części na postępowania w sprawach wymienionych w § 2.

Artykuł 4 Immunitet

Kodeks postępowania administracyjnego nie narusza szczególnych uprawnień wynikających z immunitetu dyplomatycznego i konsularnego oraz umów i zwyczajów międzynarodowych.

Artykuł 5 Pojęcie

§ 1. Jeżeli przepis prawa powołuje się ogólnie na przepisy o postępowaniu administracyjnym, rozumie się przez to przepisy Kodeksu postępowania administracyjnego.

§ 2. Ilekroć w przepisach Kodeksu postępowania administracyjnego jest mowa o:

1) kodeksie - rozumie się przez to Kodeks postępowania administracyjnego;

2) (uchylony)

3) organach administracji publicznej - rozumie się przez to ministrów, centralne organy administracji rządowej, wojewodów, działające w ich lub we własnym imieniu inne terenowe organy administracji rządowej (zespolonej i niezespolonej), organy jednostek samorządu terytorialnego oraz organy i podmioty wymienione w art. 1 pkt 2;

4) ministrach - rozumie się przez to Prezesa i wiceprezesa Rady Ministrów pełniących funkcję ministra kierującego określonym działem administracji rządowej, ministrów kierujących określonym działem administracji rządowej, przewodniczących komitetów wchodzących w skład Rady Ministrów, kierowników centralnych urzędów administracji rządowej podległych, podporządkowanych lub nadzorowanych przez Prezesa Rady Ministrów lub właściwego ministra, a także kierowników innych równorzędnych urzędów państwowych załatwiających sprawy, o których mowa w art. 1 pkt 1 i 4;

5) organizacjach społecznych - rozumie się przez to organizacje zawodowe, samorządowe, spółdzielcze i inne organizacje społeczne;

6) organach jednostek samorządu terytorialnego - rozumie się przez to organy gminy, powiatu, województwa, związków gmin, związków powiatów, wójta, burmistrza (prezydenta miasta), starostę, marszałka województwa oraz kierowników służb, inspekcji i straży działających w imieniu wójta, burmistrza (prezydenta miasta), starosty lub marszałka województwa, a ponadto samorządowe kolegia odwoławcze.

Rozdział 2. Zasady ogólne

Artykuł 6 Zasada praworządności

Organy administracji publicznej działają na podstawie przepisów prawa.

Artykuł 7 Zasada prawdy obiektywnej

W toku postępowania organy administracji publicznej stoją na straży praworządności, z urzędu lub na wniosek stron podejmują wszelkie czynności niezbędne do dokładnego wyjaśnienia stanu faktycznego oraz do załatwienia sprawy, mając na względzie interes społeczny i słuszny interes obywateli.

Artykuł 7a Zasada rozstrzygania wątpliwości interpretacyjnych

§ 1. Jeżeli przedmiotem postępowania administracyjnego jest nałożenie na stronę obowiązku bądź ograniczenie lub odebranie stronie uprawnienia, a w sprawie pozostają wątpliwości co do treści normy prawnej, wątpliwości te są rozstrzygane na korzyść strony, chyba że sprzeciwiają się temu sporne interesy stron albo interesy osób trzecich, na które wynik postępowania ma bezpośredni wpływ.

§ 2. Przepisu § 1 nie stosuje się:

1) jeżeli wymaga tego ważny interes publiczny, w tym istotne interesy państwa, a w szczególności jego bezpieczeństwa, obronności lub porządku publicznego;

2) w sprawach osobowych funkcjonariuszy oraz żołnierzy zawodowych.

Artykuł 7b Zasada adekwatności, proporcjonalności

W toku postępowania organy administracji publicznej współdziałają ze sobą w zakresie niezbędnym do dokładnego wyjaśnienia stanu faktycznego i prawnego sprawy, mając na względzie interes społeczny i słuszny interes obywateli oraz sprawność postępowania, przy pomocy środków adekwatnych do charakteru, okoliczności i stopnia złożoności sprawy.

Artykuł 8 Zasada pogłębiania zaufania

§ 1. Organy administracji publicznej prowadzą postępowanie w sposób budzący zaufanie jego uczestników do władzy publicznej, kierując się zasadami proporcjonalności, bezstronności i równego traktowania.

§ 2. Organy administracji publicznej bez uzasadnionej przyczyny nie odstępują od utrwalonej praktyki rozstrzygania spraw w takim samym stanie faktycznym i prawnym.

Artykuł 9 Zasada udzielania informacji

Organy administracji publicznej są obowiązane do należytego i wyczerpującego informowania stron o okolicznościach faktycznych i prawnych, które mogą mieć wpływ na ustalenie ich praw i obowiązków będących przedmiotem postępowania administracyjnego. Organy czuwają nad tym, aby strony i inne osoby uczestniczące w postępowaniu nie poniosły szkody z powodu nieznajomości prawa, i w tym celu udzielają im niezbędnych wyjaśnień i wskazówek.

Artykuł 10 Zasada wysłuchania stron

§ 1. Organy administracji publicznej obowiązane są zapewnić stronom czynny udział w każdym stadium postępowania, a przed wydaniem decyzji umożliwić im wypowiedzenie się co do zebranych dowodów i materiałów oraz zgłoszonych żądań.

§ 2. Organy administracji publicznej mogą odstąpić od zasady określonej w § 1 tylko w przypadkach, gdy załatwienie sprawy nie cierpi zwłoki ze względu na niebezpieczeństwo dla życia lub zdrowia ludzkiego albo ze względu na grożącą niepowetowaną szkodę materialną.

§ 3. Organ administracji publicznej obowiązany jest utrwalić w aktach sprawy, w drodze adnotacji, przyczyny odstąpienia od zasady określonej w § 1.

Artykuł 11 Wyjaśnianie zasadności przesłanek

Organy administracji publicznej powinny wyjaśniać stronom zasadność przesłanek, którymi kierują się przy załatwieniu sprawy, aby w ten sposób w miarę możności doprowadzić do wykonania przez strony decyzji bez potrzeby stosowania środków przymusu.

Artykuł 12 Zasada szybkości i prostoty postępowania

§ 1. Organy administracji publicznej powinny działać w sprawie wnikliwie i szybko, posługując się możliwie najprostszymi środkami prowadzącymi do jej załatwienia.

§ 2. Sprawy, które nie wymagają zbierania dowodów, informacji lub wyjaśnień, powinny być załatwione niezwłocznie.

Artykuł 13 Zasada polubownego rozstrzygania kwestii spornych

§ 1. Organy administracji publicznej w sprawach, których charakter na to pozwala, dążą do polubownego rozstrzygania kwestii spornych oraz ustalania praw i obowiązków będących przedmiotem postępowania w należących do ich właściwości sprawach, w szczególności przez podejmowanie czynności:

1) skłaniających strony do zawarcia ugody, w sprawach, w których uczestniczą strony o spornych interesach;

2) niezbędnych do przeprowadzenia mediacji.

§ 2. Organy administracji publicznej podejmują wszystkie uzasadnione na danym etapie postępowania czynności umożliwiające przeprowadzenie mediacji lub zawarcie ugody, a w szczególności udzielają wyjaśnień o możliwościach i korzyściach polubownego załatwienia sprawy.

Artykuł 14 Zasada pisemności

§ 1. Sprawy należy załatwiać w formie pisemnej lub w formie dokumentu elektronicznego w rozumieniu przepisów ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne (Dz.U. z 2017 r. poz. 570), doręczanego środkami komunikacji elektronicznej.

§ 2. Sprawy mogą być załatwiane ustnie, gdy przemawia za tym interes strony, a przepis prawny nie stoi temu na przeszkodzie. Treść oraz istotne motywy takiego załatwienia powinny być utrwalone w aktach w formie protokołu lub podpisanej przez stronę adnotacji.

Artykuł 15 Zasada dwuinstancyjności

Postępowanie administracyjne jest dwuinstancyjne, chyba że przepis szczególny stanowi inaczej.

Artykuł 16 Zasada trwałości decyzji

§ 1. Decyzje, od których nie służy odwołanie w administracyjnym toku instancji lub wniosek o ponowne rozpatrzenie sprawy, są ostateczne. Uchylenie lub zmiana takich decyzji, stwierdzenie ich nieważności oraz wznowienie postępowania może nastąpić tylko w przypadkach przewidzianych w kodeksie lub ustawach szczególnych.

§ 2. Decyzje mogą być zaskarżane do sądu administracyjnego z powodu ich niezgodności z prawem, na zasadach i w trybie określonych w odrębnych ustawach.

§ 3. Decyzje ostateczne, których nie można zaskarżyć do sądu, są prawomocne.

Rozdział 3. Organy wyższego stopnia i organy naczelne

Artykuł 17 Słowniczek

Organami wyższego stopnia w rozumieniu kodeksu są:

1) w stosunku do organów jednostek samorządu terytorialnego - samorządowe kolegia odwoławcze, chyba że ustawy szczególne stanowią inaczej;

2) w stosunku do wojewodów - właściwi w sprawie ministrowie;

3) w stosunku do organów administracji publicznej innych niż określone w pkt 1 i 2 - odpowiednie organy nadrzędne lub właściwi ministrowie, a w razie ich braku - organy państwowe sprawujące nadzór nad ich działalnością;

4) w stosunku do organów organizacji społecznych - odpowiednie organy wyższego stopnia tych organizacji, a w razie ich braku - organ państwowy sprawujący nadzór nad ich działalnością.

Artykuł 18 Pojęcie

Organami naczelnymi w rozumieniu kodeksu są:

1) w stosunku do organów administracji rządowej, organów jednostek samorządu terytorialnego, z wyjątkiem samorządowych kolegiów odwoławczych, oraz organów państwowych i samorządowych jednostek organizacyjnych - Prezes Rady Ministrów lub właściwi ministrowie;

2) w stosunku do organów państwowych innych niż określone w pkt 1 - odpowiednie organy o ogólnokrajowym zasięgu działania;

3) w stosunku do organów organizacji społecznych - naczelne organy tych organizacji, a w razie braku takiego organu - Prezes Rady Ministrów lub właściwi ministrowie sprawujący zwierzchni nadzór nad ich działalnością.

Rozdział 4. Właściwość organów

Artykuł 19 Przestrzeganie właściwości

Organy administracji publicznej przestrzegają z urzędu swojej właściwości rzeczowej i miejscowej.

Artykuł 20 Właściwość rzeczowa

Właściwość rzeczową organu administracji publicznej ustala się według przepisów o zakresie jego działania.

Artykuł 21 Właściwość miejscowa

§ 1. Właściwość miejscową organu administracji publicznej ustala się:

1) w sprawach dotyczących nieruchomości - według miejsca jej położenia; jeżeli nieruchomość położona jest na obszarze właściwości dwóch lub więcej organów, orzekanie należy do organu, na którego obszarze znajduje się większa część nieruchomości;

2) w sprawach dotyczących prowadzenia zakładu pracy - według miejsca, w którym zakład pracy jest, był lub ma być prowadzony;

3) w innych sprawach - według miejsca zamieszkania (siedziby) w kraju, a w braku zamieszkania w kraju - według miejsca pobytu strony lub jednej ze stron; jeżeli żadna ze stron nie ma w kraju zamieszkania (siedziby) lub pobytu - według miejsca ostatniego ich zamieszkania (siedziby) lub pobytu w kraju.

§ 2. Jeżeli nie można ustalić właściwości miejscowej w sposób wskazany w § 1, sprawa należy do organu właściwego dla miejsca, w którym nastąpiło zdarzenie powodujące wszczęcie postępowania, albo w razie braku ustalenia takiego miejsca - do organu właściwego dla obszaru dzielnicy Śródmieście w m.st. Warszawie.

Artykuł 22 Właściwość organów

§ 1. Spory o właściwość rozstrzygają:

1) między organami jednostek samorządu terytorialnego, z wyjątkiem przypadków określonych w pkt 2-4 - wspólny dla nich organ wyższego stopnia, a w razie braku takiego organu - sąd administracyjny;

2) między kierownikami służb, inspekcji i straży administracji zespolonej tego samego powiatu, działających w imieniu własnym lub w imieniu starosty - starosta;

3) między organami administracji zespolonej w jednym województwie niewymienionymi w pkt 2 - wojewoda;

4) między organami jednostek samorządu terytorialnego w różnych województwach w sprawach należących do zadań z zakresu administracji rządowej - minister właściwy do spraw administracji publicznej;

5) (uchylony)

6) między wojewodami oraz organami administracji zespolonej w różnych województwach - minister właściwy do spraw administracji publicznej;

7) między wojewodą a organami administracji niezespolonej - minister właściwy do spraw administracji publicznej po porozumieniu z organem sprawującym nadzór nad organem pozostającym w sporze z wojewodą;

8) między organami administracji publicznej innymi niż wymienione w pkt 1-4, 6 i 7 - wspólny dla nich organ wyższego stopnia, a w razie braku takiego organu - minister właściwy do spraw administracji publicznej;

9) między organami administracji publicznej, gdy jednym z nich jest minister - Prezes Rady Ministrów.

§ 2. Spory kompetencyjne między organami jednostek samorządu terytorialnego a organami administracji rządowej rozstrzyga sąd administracyjny.

§ 3. Z wnioskiem o rozpatrzenie sporu przez sąd administracyjny może wystąpić:

1) strona;

2) organ jednostki samorządu terytorialnego lub inny organ administracji publicznej, pozostające w sporze;

3) minister właściwy do spraw administracji publicznej;

4) minister właściwy do spraw sprawiedliwości, Prokurator Generalny;

5) Rzecznik Praw Obywatelskich.

Artykuł 23 Czynności organu

Do czasu rozstrzygnięcia sporu o właściwość organ administracji publicznej, na którego obszarze wynikła sprawa, podejmuje tylko czynności niecierpiące zwłoki ze względu na interes społeczny lub słuszny interes obywateli i zawiadamia o tym organ właściwy do rozstrzygnięcia sporu.

Rozdział 5. Wyłączenie pracownika oraz organu

Artykuł 24 Podstawy wyłączenia pracownika

§ 1. Pracownik organu administracji publicznej podlega wyłączeniu od udziału w postępowaniu w sprawie:

1) w której jest stroną albo pozostaje z jedną ze stron w takim stosunku prawnym, że wynik sprawy może mieć wpływ na jego prawa lub obowiązki;

2) swego małżonka oraz krewnych i powinowatych do drugiego stopnia;

3) osoby związanej z nim z tytułu przysposobienia, opieki lub kurateli;

4) w której był świadkiem lub biegłym albo był lub jest przedstawicielem jednej ze stron, albo w której przedstawicielem strony jest jedna z osób wymienionych w pkt 2 i 3;

5) w której brał udział w wydaniu zaskarżonej decyzji;

6) z powodu której wszczęto przeciw niemu dochodzenie służbowe, postępowanie dyscyplinarne lub karne;

7) w której jedną ze stron jest osoba pozostająca wobec niego w stosunku nadrzędności służbowej.

§ 2. Powody wyłączenia pracownika od udziału w postępowaniu trwają także po ustaniu małżeństwa (§ 1 pkt 2), przysposobienia, opieki lub kurateli (§ 1 pkt 3).

§ 3. Bezpośredni przełożony pracownika jest obowiązany na jego żądanie lub na żądanie strony albo z urzędu wyłączyć go od udziału w postępowaniu, jeżeli zostanie uprawdopodobnione istnienie okoliczności niewymienionych w § 1, które mogą wywołać wątpliwość co do bezstronności pracownika.

§ 4. Wyłączony pracownik powinien podejmować tylko czynności niecierpiące zwłoki ze względu na interes społeczny lub ważny interes stron.

Artykuł 25 Podstawy wyłączenia organu

§ 1. Organ administracji publicznej podlega wyłączeniu od załatwienia sprawy dotyczącej interesów majątkowych:

1) jego kierownika lub osób pozostających z tym kierownikiem w stosunkach określonych w art. 24 § 1 pkt 2 i 3;

2) osoby zajmującej stanowisko kierownicze w organie bezpośrednio wyższego stopnia lub osób pozostających z nim w stosunkach określonych w art. 24 § 1 pkt 2 i 3.

§ 2. Przepis art. 24 § 4 stosuje się odpowiednio.

Artykuł 26 Wyznaczenie pracownika i organu

§ 1. W przypadku wyłączenia pracownika (art. 24) jego bezpośredni przełożony wyznacza innego pracownika do prowadzenia sprawy.

§ 2. W przypadku wyłączenia organu sprawę załatwia:

1) w okolicznościach przewidzianych w art. 25 § 1 pkt 1 - organ wyższego stopnia nad organem załatwiającym sprawę;

2) w okolicznościach przewidzianych w art. 25 § 1 pkt 2 - organ wyższego stopnia nad organem, w którym osoba wymieniona w tym przepisie zajmuje stanowisko kierownicze.

Organ wyższego stopnia może do załatwienia sprawy wyznaczyć inny podległy sobie organ. W razie gdy osobą wymienioną w art. 25 § 1 pkt 2 jest minister albo prezes samorządowego kolegium odwoławczego, organ właściwy do załatwienia sprawy wyznacza Prezes Rady Ministrów.

§ 3. Jeżeli wskutek wyłączenia pracowników organu administracji publicznej organ ten stał się niezdolny do załatwienia sprawy, stosuje się odpowiednio § 2.

Artykuł 27 Członek organu kolegialnego

§ 1. Członek organu kolegialnego podlega wyłączeniu w przypadkach określonych w art. 24 § 1. O wyłączeniu tego członka w przypadkach określonych w art. 24 § 3 postanawia przewodniczący organu kolegialnego lub organu wyższego stopnia na wniosek strony, członka organu kolegialnego albo z urzędu.

§ 1a. Członek samorządowego kolegium odwoławczego podlega wyłączeniu od udziału w postępowaniu w sprawie wniosku o ponowne rozpatrzenie sprawy, jeżeli brał udział w wydaniu decyzji objętej wnioskiem.

§ 2. Jeżeli wskutek wyłączenia członków organu kolegialnego organ ten stał się niezdolny do podjęcia uchwały z braku wymaganego quorum, stosuje się odpowiednio przepisy art. 26 § 2.

§ 3. Jeżeli samorządowe kolegium odwoławcze wskutek wyłączenia jego członków nie może załatwić sprawy, minister właściwy do spraw administracji publicznej, w drodze postanowienia, wyznacza inne samorządowe kolegium odwoławcze.

Artykuł 27a (uchylony)

Rozdział 6. Strona

Artykuł 28 Definicja

Stroną jest każdy, czyjego interesu prawnego lub obowiązku dotyczy postępowanie albo kto żąda czynności organu ze względu na swój interes prawny lub obowiązek.

Artykuł 29 Pojęcie

Stronami mogą być osoby fizyczne i osoby prawne, a gdy chodzi o państwowe i samorządowe jednostki organizacyjne i organizacje społeczne - również jednostki nieposiadające osobowości prawnej.

Artykuł 30 Odesłanie

§ 1. Zdolność prawną i zdolność do czynności prawnych stron ocenia się według przepisów prawa cywilnego, o ile przepisy szczególne nie stanowią inaczej.

§ 2. Osoby fizyczne nieposiadające zdolności do czynności prawnych działają przez swych ustawowych przedstawicieli.

§ 3. Strony niebędące osobami fizycznymi działają przez swych ustawowych lub statutowych przedstawicieli.

§ 4. W sprawach dotyczących praw zbywalnych lub dziedzicznych w razie zbycia prawa lub śmierci strony w toku postępowania na miejsce dotychczasowej strony wstępują jej następcy prawni.

§ 5. W sprawach dotyczących spadków nieobjętych jako strony działają osoby sprawujące zarząd majątkiem masy spadkowej, a w ich braku - kurator wyznaczony przez sąd na wniosek organu administracji publicznej.

Artykuł 31 Uprawnienia

§ 1. Organizacja społeczna może w sprawie dotyczącej innej osoby występować z żądaniem:

1) wszczęcia postępowania,

2) dopuszczenia jej do udziału w postępowaniu,

jeżeli jest to uzasadnione celami statutowymi tej organizacji i gdy przemawia za tym interes społeczny.

§ 1a. Organizacja społeczna, o której mowa w § 1, może brać udział w postępowaniu w imieniu i na rzecz pracownika delegowanego na terytorium RP lub z terytorium RP albo pracodawcy delegującego pracownika na terytorium RP lub z terytorium RP - za zgodą strony w imieniu i na rzecz której występuje w postępowaniu.

§ 2. Organ administracji publicznej, uznając żądanie organizacji społecznej za uzasadnione, postanawia o wszczęciu postępowania z urzędu lub o dopuszczeniu organizacji do udziału w postępowaniu. Na postanowienie o odmowie wszczęcia postępowania lub dopuszczenia do udziału w postępowaniu organizacji społecznej służy zażalenie.

§ 3. Organizacja społeczna uczestniczy w postępowaniu na prawach strony.

§ 4. Organ administracji publicznej, wszczynając postępowanie w sprawie dotyczącej innej osoby, zawiadamia o tym organizację społeczną, jeżeli uzna, że może ona być zainteresowana udziałem w tym postępowaniu ze względu na swoje cele statutowe, i gdy przemawia za tym interes społeczny.

§ 5. Organizacja społeczna, która nie uczestniczy w postępowaniu na prawach strony, może za zgodą organu administracji publicznej przedstawić temu organowi swój pogląd w sprawie, wyrażony w uchwale lub oświadczeniu jej organu statutowego.

§ 6. (uchylony)

Artykuł 32 Ustanowienie pełnomocnika

Strona może działać przez pełnomocnika, chyba że charakter czynności wymaga jej osobistego działania.

Artykuł 33 Przesłanki i tryb

§ 1. Pełnomocnikiem strony może być osoba fizyczna posiadająca zdolność do czynności prawnych.

§ 2. Pełnomocnictwo powinno być udzielone na piśmie, w formie dokumentu elektronicznego lub zgłoszone do protokołu.

§ 2a. Pełnomocnictwo w formie dokumentu elektronicznego powinno być opatrzone kwalifikowanym podpisem elektronicznym albo podpisem potwierdzonym profilem zaufanym ePUAP.

§ 3. Pełnomocnik dołącza do akt oryginał lub urzędowo poświadczony odpis pełnomocnictwa. Adwokat, radca prawny, rzecznik patentowy, a także doradca podatkowy mogą sami uwierzytelnić odpis udzielonego im pełnomocnictwa oraz odpisy innych dokumentów wykazujących ich umocowanie. Organ administracji publicznej może w razie wątpliwości zażądać urzędowego poświadczenia podpisu strony.

§ 3a. Jeżeli odpis pełnomocnictwa lub odpisy innych dokumentów wykazujących umocowanie zostały sporządzone w formie dokumentu elektronicznego, ich uwierzytelnienia, o którym mowa w § 3, dokonuje się, opatrując odpisy kwalifikowanym podpisem elektronicznym albo podpisem potwierdzonym profilem zaufanym ePUAP. Odpisy pełnomocnictwa lub odpisy innych dokumentów wykazujących umocowanie uwierzytelniane elektronicznie są sporządzane w formatach danych określonych w przepisach wydanych na podstawie art. 18 pkt 1 ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne.

§ 4. W sprawach mniejszej wagi organ administracji publicznej może nie żądać pełnomocnictwa, jeśli pełnomocnikiem jest członek najbliższej rodziny lub domownik strony, a nie ma wątpliwości co do istnienia i zakresu upoważnienia do występowania w imieniu strony.

Artykuł 34 Wyznaczenie przedstawiciela

§ 1. Organ administracji publicznej wystąpi do sądu z wnioskiem o wyznaczenie przedstawiciela dla osoby nieobecnej lub niezdolnej do czynności prawnych, o ile przedstawiciel nie został już wyznaczony.

§ 2. W przypadku konieczności podjęcia czynności niecierpiącej zwłoki organ administracji publicznej wyznacza dla osoby nieobecnej przedstawiciela uprawnionego do działania w postępowaniu do czasu wyznaczenia dla niej przedstawiciela przez sąd.

Rozdział 7. Załatwianie spraw

Artykuł 35 Terminy załatwiania

§ 1. Organy administracji publicznej obowiązane są załatwiać sprawy bez zbędnej zwłoki.

§ 2. Niezwłocznie powinny być załatwiane sprawy, które mogą być rozpatrzone w oparciu o dowody przedstawione przez stronę łącznie z żądaniem wszczęcia postępowania lub w oparciu o fakty i dowody powszechnie znane albo znane z urzędu organowi, przed którym toczy się postępowanie, bądź możliwe do ustalenia na podstawie danych, którymi rozporządza ten organ.

§ 3. Załatwienie sprawy wymagającej postępowania wyjaśniającego powinno nastąpić nie później niż w ciągu miesiąca, a sprawy szczególnie skomplikowanej - nie później niż w ciągu dwóch miesięcy od dnia wszczęcia postępowania, zaś w postępowaniu odwoławczym - w ciągu miesiąca od dnia otrzymania odwołania.

§ 3a. Załatwienie sprawy w postępowaniu uproszczonym powinno nastąpić niezwłocznie, nie później niż w terminie miesiąca od dnia wszczęcia postępowania.

§ 4. Przepisy szczególne mogą określać inne terminy niż określone w § 3 i 3a.

§ 5. Do terminów określonych w przepisach poprzedzających nie wlicza się terminów przewidzianych w przepisach prawa dla dokonania określonych czynności, okresów zawieszenia postępowania, okresu trwania mediacji oraz okresów opóźnień spowodowanych z winy strony albo przyczyn niezależnych od organu.

Artykuł 36 Przekroczenie terminu

§ 1. O każdym przypadku niezałatwienia sprawy w terminie organ administracji publicznej jest obowiązany zawiadomić strony, podając przyczyny zwłoki, wskazując nowy termin załatwienia sprawy oraz pouczając o prawie do wniesienia ponaglenia.

§ 2. Ten sam obowiązek ciąży na organie administracji publicznej również w przypadku zwłoki w załatwieniu sprawy z przyczyn niezależnych od organu.

Artykuł 37 Prawo do wniesienia ponaglenia

§ 1. Stronie służy prawo do wniesienia ponaglenia, jeżeli:

1) nie załatwiono sprawy w terminie określonym w art. 35 lub przepisach szczególnych ani w terminie wskazanym zgodnie z art. 36 § 1 (bezczynność);

2) postępowanie jest prowadzone dłużej niż jest to niezbędne do załatwienia sprawy (przewlekłość).

§ 2. Ponaglenie zawiera uzasadnienie.

§ 3. Ponaglenie wnosi się:

1) do organu wyższego stopnia za pośrednictwem organu prowadzącego postępowanie;

2) do organu prowadzącego postępowanie - jeżeli nie ma organu wyższego stopnia.

§ 4. Organ prowadzący postępowanie jest obowiązany przekazać ponaglenie organowi wyższego stopnia bez zbędnej zwłoki, nie później niż w terminie siedmiu dni od dnia jego otrzymania. Organ przekazuje ponaglenie wraz z niezbędnymi odpisami akt sprawy. Odpisy mogą zostać sporządzone w formie dokumentu elektronicznego. Przekazując ponaglenie, organ jest obowiązany ustosunkować się do niego.

§ 5. Organ, o którym mowa w § 3, rozpatruje ponaglenie w terminie siedmiu dni od dnia jego otrzymania.

§ 6. Organ rozpatrujący ponaglenie wydaje postanowienie, w którym:

1) wskazuje, czy organ rozpatrujący sprawę dopuścił się bezczynności lub przewlekłego prowadzenia postępowania, stwierdzając jednocześnie, czy miało ono miejsce z rażącym naruszeniem prawa;

2) w przypadku stwierdzenia bezczynności lub przewlekłości:

a) zobowiązuje organ rozpatrujący sprawę do załatwienia sprawy, wyznaczając termin do jej załatwienia, jeżeli postępowanie jest niezakończone,

b) zarządza wyjaśnienie przyczyn i ustalenie osób winnych bezczynności lub przewlekłości, a w razie potrzeby także podjęcie środków zapobiegających bezczynności lub przewlekłości w przyszłości.

§ 7. Organ rozpatrujący ponaglenie może z urzędu zmienić postanowienie, o którym mowa w § 6, wyznaczając dłuższy termin zakończenia postępowania, jeżeli wyjdą na jaw istotne dla sprawy nowe okoliczności faktyczne lub nowe dowody, wymagające dłuższego postępowania, nieznane w momencie wyznaczania terminu.

§ 8. W przypadku, o którym mowa w § 3 pkt 2, przepisów § 4, 6 i 7 nie stosuje się. W przypadku stwierdzenia bezczynności lub przewlekłości organ prowadzący postępowanie niezwłocznie załatwia sprawę oraz zarządza wyjaśnienie przyczyn i ustalenie osób winnych bezczynności lub przewlekłości, a w razie potrzeby także podjęcie środków zapobiegających bezczynności lub przewlekłości w przyszłości.

Artykuł 38 Odpowiedzialność pracownika

Pracownik organu administracji publicznej podlega odpowiedzialności porządkowej lub dyscyplinarnej albo innej odpowiedzialności przewidzianej w przepisach prawa, jeżeli z nieuzasadnionych przyczyn nie załatwił sprawy w terminie lub prowadził postępowanie dłużej niż było to niezbędne do załatwienia sprawy.

Rozdział 8. Doręczenia

Artykuł 39 Sposoby doręczania

Organ administracji publicznej doręcza pisma za pokwitowaniem przez operatora pocztowego w rozumieniu ustawy z dnia 23 listopada 2012 r. - Prawo pocztowe (Dz.U. z 2016 r. poz. 1113, 1250, 1823 i 1948), przez swoich pracowników lub przez inne upoważnione osoby lub organy.

Artykuł 391 Doręczenie drogą elektroniczną

§ 1. Doręczenie pism następuje za pomocą środków komunikacji elektronicznej w rozumieniu art. 2 pkt 5 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2016 r. poz. 1030 i 1579), jeżeli strona lub inny uczestnik postępowania spełni jeden z następujących warunków:

1) złoży podanie w formie dokumentu elektronicznego przez elektroniczną skrzynkę podawczą organu administracji publicznej;

2) wystąpi do organu administracji publicznej o takie doręczenie i wskaże organowi administracji publicznej adres elektroniczny;

3) wyrazi zgodę na doręczanie pism w postępowaniu za pomocą tych środków i wskaże organowi administracji publicznej adres elektroniczny.

§ 1a. Organ administracji publicznej może zwrócić się do strony lub innego uczestnika postępowania o wyrażenie zgody na doręczanie pism w formie dokumentu elektronicznego w innych, określonych przez organ kategoriach spraw indywidualnych załatwianych przez ten organ.

§ 1b. Organ administracji publicznej może wystąpić o wyrażenie zgody, o której mowa w § 1 pkt 3 lub w § 1a, przesyłając to wystąpienie za pomocą środków komunikacji elektronicznej na adres elektroniczny strony lub innego uczestnika postępowania.

§ 1c. Do wystąpienia, o którym mowa w § 1b, nie stosuje się art. 46 § 3-8.

§ 1d. Jeżeli strona lub inny uczestnik postępowania zrezygnuje z doręczania pism za pomocą środków komunikacji elektronicznej, organ administracji publicznej doręcza pismo w sposób określony dla pisma w formie innej niż forma dokumentu elektronicznego.

§ 2. (uchylony)

Artykuł 392 Doręczenie na elektroniczną skrzynkę podawczą

W przypadku gdy stroną lub innym uczestnikiem postępowania jest podmiot publiczny obowiązany do udostępniania i obsługi elektronicznej skrzynki podawczej na podstawie art. 16 ust. 1a ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne doręczenia dokonuje się na elektroniczną skrzynkę podawczą tego podmiotu. Przepisu art. 391 nie stosuje się.

Artykuł 40 Pozycja przedstawiciela

§ 1. Pisma doręcza się stronie, a gdy strona działa przez przedstawiciela - temu przedstawicielowi.

§ 2. Jeżeli strona ustanowiła pełnomocnika, pisma doręcza się pełnomocnikowi. Jeżeli ustanowiono kilku pełnomocników, doręcza się pisma tylko jednemu pełnomocnikowi. Strona może wskazać takiego pełnomocnika.

§ 3. W sprawie wszczętej na skutek podania złożonego przez dwie lub więcej stron pisma doręcza się wszystkim stronom, chyba że w podaniu wskazały jedną jako upoważnioną do odbioru pism.

§ 4. Strona, która nie ma miejsca zamieszkania lub zwykłego pobytu albo siedziby w Rzeczypospolitej Polskiej lub innym państwie członkowskim Unii Europejskiej, jeżeli nie ustanowiła pełnomocnika do prowadzenia sprawy zamieszkałego w Rzeczypospolitej Polskiej i nie działa za pośrednictwem konsula Rzeczypospolitej Polskiej, jest obowiązana wskazać w Rzeczypospolitej Polskiej pełnomocnika do doręczeń, chyba że doręczenie następuje za pomocą środków komunikacji elektronicznej.

§ 5. W razie niewskazania pełnomocnika do doręczeń przeznaczone dla tej strony pisma pozostawia się w aktach sprawy ze skutkiem doręczenia. Stronę należy o tym pouczyć przy pierwszym doręczeniu. Strona powinna być również pouczona o możliwości złożenia odpowiedzi na pismo wszczynające postępowanie i wyjaśnień na piśmie oraz o tym, kto może być ustanowiony pełnomocnikiem.

Artykuł 41 Zmiana adresu

§ 1. W toku postępowania strony oraz ich przedstawiciele i pełnomocnicy mają obowiązek zawiadomić organ administracji publicznej o każdej zmianie swojego adresu, w tym adresu elektronicznego.

§ 2. W razie zaniedbania obowiązku określonego w § 1 doręczenie pisma pod dotychczasowym adresem ma skutek prawny.

Artykuł 42 Miejsce

§ 1. Pisma doręcza się osobom fizycznym w ich mieszkaniu lub miejscu pracy.

§ 2. Pisma mogą być doręczane również w lokalu organu administracji publicznej, jeżeli przepisy szczególne nie stanowią inaczej.

§ 3. W razie niemożności doręczenia pisma w sposób określony w § 1 i 2, a także w razie koniecznej potrzeby, pisma doręcza się w każdym miejscu, gdzie się adresata zastanie.

Artykuł 43 Nieobecność adresata

W przypadku nieobecności adresata pismo doręcza się, za pokwitowaniem, dorosłemu domownikowi, sąsiadowi lub dozorcy domu, jeżeli osoby te podjęły się oddania pisma adresatowi. O doręczeniu pisma sąsiadowi lub dozorcy zawiadamia się adresata, umieszczając zawiadomienie w oddawczej skrzynce pocztowej lub, gdy to nie jest możliwe, w drzwiach mieszkania.

Artykuł 44 Doręczenie zastępcze

§ 1. W razie niemożności doręczenia pisma w sposób wskazany w art. 42 i 43:

1) operator pocztowy w rozumieniu ustawy z dnia 23 listopada 2012 r. - Prawo pocztowe przechowuje pismo przez okres 14 dni w swojej placówce pocztowej - w przypadku doręczania pisma przez operatora pocztowego;

2) pismo składa się na okres czternastu dni w urzędzie właściwej gminy (miasta) - w przypadku doręczania pisma przez pracownika urzędu gminy (miasta) lub upoważnioną osobę lub organ.

§ 2. Zawiadomienie o pozostawieniu pisma wraz z informacją o możliwości jego odbioru w terminie siedmiu dni, licząc od dnia pozostawienia zawiadomienia w miejscu określonym w § 1, umieszcza się w oddawczej skrzynce pocztowej lub, gdy nie jest to możliwe, na drzwiach mieszkania adresata, jego biura lub innego pomieszczenia, w którym adresat wykonuje swoje czynności zawodowe, bądź w widocznym miejscu przy wejściu na posesję adresata.

§ 3. W przypadku niepodjęcia przesyłki w terminie, o którym mowa w § 2, pozostawia się powtórne zawiadomienie o możliwości odbioru przesyłki w terminie nie dłuższym niż czternaście dni od daty pierwszego zawiadomienia.

§ 4. Doręczenie uważa się za dokonane z upływem ostatniego dnia okresu, o którym mowa w § 1, a pismo pozostawia się w aktach sprawy.

Artykuł 45 Doręczenie w siedzibie

Jednostkom organizacyjnym i organizacjom społecznym doręcza się pisma w lokalu ich siedziby do rąk osób uprawnionych do odbioru pism. Przepis art. 44 stosuje się odpowiednio.

Artykuł 46 Potwierdzenie odbioru

§ 1. Odbierający pismo potwierdza doręczenie mu pisma swoim podpisem ze wskazaniem daty doręczenia.

§ 2. Jeżeli odbierający pismo uchyla się od potwierdzenia doręczenia lub nie może tego uczynić, doręczający sam stwierdza datę doręczenia oraz wskazuje osobę, która odebrała pismo, i przyczynę braku jej podpisu.

§ 3. W przypadku doręczenia pisma za pomocą środków komunikacji elektronicznej doręczenie jest skuteczne, jeżeli adresat potwierdzi odbiór pisma w sposób, o którym mowa w § 4 pkt 3.

§ 4. W celu doręczenia pisma w formie dokumentu elektronicznego organ administracji publicznej przesyła na adres elektroniczny adresata zawiadomienie zawierające:

1) wskazanie, że adresat może odebrać pismo w formie dokumentu elektronicznego;

2) wskazanie adresu elektronicznego, z którego adresat może pobrać pismo i pod którym powinien dokonać potwierdzenia doręczenia pisma;

3) pouczenie dotyczące sposobu odbioru pisma, a w szczególności sposobu identyfikacji pod wskazanym adresem elektronicznym w systemie teleinformatycznym organu administracji publicznej, oraz informację o wymogu podpisania urzędowego poświadczenia odbioru w określony sposób.

§ 5. W przypadku nieodebrania pisma w formie dokumentu elektronicznego w sposób, o którym mowa w § 4 pkt 3, organ administracji publicznej po upływie 7 dni, licząc od dnia wysłania zawiadomienia, przesyła powtórne zawiadomienie o możliwości odebrania tego pisma.

§ 6. W przypadku nieodebrania pisma doręczenie uważa się za dokonane po upływie czternastu dni, licząc od dnia przesłania pierwszego zawiadomienia.

§ 7. Zawiadomienia, o których mowa w § 4 i 5, mogą być automatycznie tworzone i przesyłane przez system teleinformatyczny organu administracji publicznej, a odbioru tych zawiadomień nie potwierdza się.

§ 8. W przypadku uznania pisma w formie dokumentu elektronicznego za doręczone na podstawie § 6 organ administracji publicznej umożliwia adresatowi pisma dostęp do treści pisma w formie dokumentu elektronicznego przez okres co najmniej 3 miesięcy od dnia uznania pisma w formie dokumentu elektronicznego za doręczone oraz do informacji o dacie uznania pisma za doręczone i datach wysłania zawiadomień, o których mowa w § 4 i 5, w swoim systemie teleinformatycznym.

§ 9. Warunki techniczne i organizacyjne doręczenia pisma w formie dokumentu elektronicznego określają przepisy ustawy, o której mowa w § 4 pkt 3.

§ 10. Doręczenie pisma w formie dokumentu elektronicznego do podmiotu publicznego w rozumieniu przepisów ustawy, o której mowa w § 4 pkt 3, następuje przez elektroniczną skrzynkę podawczą tego podmiotu, w sposób określony w tej ustawie.

Artykuł 47 Odmowa przyjęcia

§ 1. Jeżeli adresat odmawia przyjęcia pisma przesłanego mu przez operatora pocztowego w rozumieniu ustawy z dnia 23 listopada 2012 r. - Prawo pocztowe lub inny organ albo w inny sposób, pismo zwraca się nadawcy z adnotacją o odmowie jego przyjęcia i datą odmowy. Pismo wraz z adnotacją włącza się do akt sprawy.

§ 2. W przypadkach, o których mowa w § 1, uznaje się, że pismo doręczone zostało w dniu odmowy jego przyjęcia przez adresata.

Artykuł 48 Doręczenie przedstawicielowi

§ 1. Pisma skierowane do osób nieznanych z miejsca pobytu, dla których sąd nie wyznaczył przedstawiciela, doręcza się przedstawicielowi ustanowionemu w myśl art. 34.

§ 2. Pisma kierowane do osób korzystających ze szczególnych uprawnień wynikających z immunitetu dyplomatycznego lub konsularnego doręcza się w sposób przewidziany w przepisach szczególnych, w umowach i zwyczajach międzynarodowych.

Artykuł 49 Publiczne obwieszczenie

§ 1. Jeżeli przepis szczególny tak stanowi, zawiadomienie stron o decyzjach i innych czynnościach organu administracji publicznej może nastąpić w formie publicznego obwieszczenia, w innej formie publicznego ogłoszenia zwyczajowo przyjętej w danej miejscowości lub przez udostępnienie pisma w Biuletynie Informacji Publicznej na stronie podmiotowej właściwego organu administracji publicznej.

§ 2. Dzień, w którym nastąpiło publiczne obwieszczenie, inne publiczne ogłoszenie lub udostępnienie pisma w Biuletynie Informacji Publicznej wskazuje się w treści tego obwieszczenia, ogłoszenia lub w Biuletynie Informacji Publicznej. Zawiadomienie uważa się za dokonane po upływie czternastu dni od dnia, w którym nastąpiło publiczne obwieszczenie, inne publiczne ogłoszenie lub udostępnienie pisma w Biuletynie Informacji Publicznej.

Artykuł 49a Rozwinięcie

Poza przypadkami, o których mowa w art. 49, organ może dokonywać zawiadomienia o decyzjach i innych czynnościach organu administracji publicznej w formie, o której mowa w art. 49 § 1, jeżeli w postępowaniu bierze udział więcej niż dwadzieścia stron. Jeżeli przepis szczególny nie stanowi inaczej, zawiadomienie jest w takim przypadku skuteczne wobec stron, które zostały na piśmie uprzedzone o zamiarze zawiadamiania ich w określony sposób. Do zawiadomienia stosuje się przepis art. 49 § 2.

Artykuł 49b Sposób, forma udostępnienia odpisu decyzji, postanowienia

§ 1. W przypadku zawiadomienia strony zgodnie z art. 49 § 1 lub art. 49a o decyzji lub postanowieniu, które podlega zaskarżeniu, na wniosek strony, organ, który wydał decyzję lub postanowienie, niezwłocznie, nie później niż w terminie trzech dni od dnia otrzymania wniosku, udostępnia stronie odpis decyzji lub postanowienia w sposób i formie określonych we wniosku, chyba że środki techniczne, którymi dysponuje organ, nie umożliwiają udostępnienia w taki sposób lub takiej formie.

§ 2. Jeżeli decyzja lub postanowienie, o których mowa w § 1, nie mogą być udostępnione stronie w sposób lub formie określonych we wniosku, organ powiadamia o tym stronę i wskazuje, w jaki sposób lub jakiej formie odpis decyzji lub postanowienia może być niezwłocznie udostępniony.

Rozdział 9. Wezwania

Artykuł 50 Cel wezwania

§ 1. Organ administracji publicznej może wzywać osoby do udziału w podejmowanych czynnościach i do złożenia wyjaśnień lub zeznań osobiście, przez pełnomocnika, na piśmie lub w formie dokumentu elektronicznego, jeżeli jest to niezbędne dla rozstrzygnięcia sprawy lub dla wykonywania czynności urzędowych.

§ 2. Organ obowiązany jest dołożyć starań, aby zadośćuczynienie wezwaniu nie było uciążliwe.

§ 3. W przypadkach, w których osoba wezwana nie może stawić się z powodu choroby, kalectwa lub innej niedającej się pokonać przeszkody, organ może dokonać określonej czynności lub przyjąć wyjaśnienie albo przesłuchać osobę wezwaną w miejscu jej pobytu, jeżeli pozwalają na to okoliczności, w jakich znajduje się ta osoba.

Artykuł 51 Osobiste stawiennictwo

§ 1. Do osobistego stawienia się wezwany jest obowiązany tylko w obrębie gminy lub miasta, w którym zamieszkuje albo przebywa.

§ 2. Obowiązek osobistego stawiennictwa dotyczy również wezwanego, zamieszkałego lub przebywającego w sąsiedniej gminie albo mieście.

Artykuł 52 Pomoc prawna

W toku postępowania organ administracji publicznej zwraca się do właściwego terenowego organu administracji rządowej lub organu samorządu terytorialnego o wezwanie osoby zamieszkałej lub przebywającej w danej gminie lub mieście do złożenia wyjaśnień lub zeznań albo do dokonania innych czynności, związanych z toczącym się postępowaniem. Organ prowadzący postępowanie oznaczy zarazem okoliczności będące przedmiotem wyjaśnień lub zeznań albo czynności, jakie mają być dokonane.

Artykuł 53 Wyłączenie

Przepisów art. 51 i 52 nie stosuje się w przypadkach, w których charakter sprawy lub czynności wymaga dokonania czynności przed organem administracji publicznej prowadzącym postępowanie.

Artykuł 54 Treść wezwania

§ 1. W wezwaniu należy wskazać:

1) nazwę i adres organu wzywającego;

2) imię i nazwisko wzywanego;

3) w jakiej sprawie oraz w jakim charakterze i w jakim celu zostaje wezwany;

4) czy wezwany powinien się stawić osobiście lub przez pełnomocnika, czy też może złożyć wyjaśnienie lub zeznanie na piśmie lub w formie dokumentu elektronicznego;

5) termin, do którego żądanie powinno być spełnione, albo dzień, godzinę i miejsce stawienia się wezwanego lub jego pełnomocnika;

6) skutki prawne niezastosowania się do wezwania.

§ 2. Wezwanie powinno być opatrzone podpisem pracownika organu wzywającego, z podaniem imienia, nazwiska i stanowiska służbowego podpisującego lub, jeżeli dokonywane jest z użyciem dokumentu elektronicznego, powinno być opatrzone kwalifikowanym podpisem elektronicznym.

Artykuł 55 Wezwanie w szczególnej formie

§ 1. W sprawach niecierpiących zwłoki wezwania można dokonać również telefonicznie albo przy użyciu innych środków łączności, z podaniem danych wymienionych w art. 54 § 1 oraz imienia, nazwiska i stanowiska służbowego pracownika organu wzywającego.

§ 2. Wezwanie dokonane w sposób określony w § 1 powoduje skutki prawne tylko wtedy, gdy nie ma wątpliwości, że dotarło do adresata we właściwej treści i w odpowiednim terminie.

Artykuł 56 Koszty stawiennictwa

§ 1. Osobie, która stawiła się na wezwanie, przyznaje się koszty podróży i inne należności ustalone zgodnie z przepisami zawartymi w dziale 2 tytułu III ustawy z dnia 28 lipca 2005 r. o kosztach sądowych w sprawach cywilnych (Dz.U. z 2016 r. poz. 623 oraz z 2017 r. poz. 85). Dotyczy to również kosztów osobistego stawiennictwa stron, gdy postępowanie zostało wszczęte z urzędu albo gdy strona bez swojej winy została błędnie wezwana do stawienia się.

§ 2. Żądanie przyznania należności należy zgłosić organowi administracji publicznej, przed którym toczy się postępowanie, przed wydaniem decyzji, pod rygorem utraty roszczenia.

Rozdział 10. Terminy

Artykuł 57 Obliczanie terminów

§ 1. Jeżeli początkiem terminu określonego w dniach jest pewne zdarzenie, przy obliczaniu tego terminu nie uwzględnia się dnia, w którym zdarzenie nastąpiło. Upływ ostatniego z wyznaczonej liczby dni uważa się za koniec terminu.

§ 2. Terminy określone w tygodniach kończą się z upływem tego dnia w ostatnim tygodniu, który nazwą odpowiada początkowemu dniowi terminu.

§ 3. Terminy określone w miesiącach kończą się z upływem tego dnia w ostatnim miesiącu, który odpowiada początkowemu dniowi terminu, a gdyby takiego dnia w ostatnim miesiącu nie było - w ostatnim dniu tego miesiąca.

§ 3a. Terminy określone w latach kończą się z upływem tego dnia w ostatnim roku, który odpowiada początkowemu dniowi terminu, a gdyby takiego dnia w ostatnim roku nie było - w dniu poprzedzającym bezpośrednio ten dzień.

§ 4. Jeżeli koniec terminu do wykonania czynności przypada na dzień uznany ustawowo za wolny od pracy lub na sobotę, termin upływa następnego dnia, który nie jest dniem wolnym od pracy ani sobotą.

§ 5. Termin uważa się za zachowany, jeżeli przed jego upływem pismo zostało:

1) wysłane w formie dokumentu elektronicznego do organu administracji publicznej, a nadawca otrzymał urzędowe poświadczenie odbioru;

2) nadane w polskiej placówce pocztowej operatora wyznaczonego w rozumieniu ustawy z dnia 23 listopada 2012 r. - Prawo pocztowe;

3) złożone w polskim urzędzie konsularnym;

4) złożone przez żołnierza w dowództwie jednostki wojskowej;

5) złożone przez członka załogi statku morskiego kapitanowi statku;

6) złożone przez osobę pozbawioną wolności w administracji zakładu karnego.

Artykuł 58 Przywrócenie terminu

§ 1. W razie uchybienia terminu należy przywrócić termin na prośbę zainteresowanego, jeżeli uprawdopodobni, że uchybienie nastąpiło bez jego winy.

§ 2. Prośbę o przywrócenie terminu należy wnieść w ciągu siedmiu dni od dnia ustania przyczyny uchybienia terminu. Jednocześnie z wniesieniem prośby należy dopełnić czynności, dla której określony był termin.

§ 3. Przywrócenie terminu do złożenia prośby przewidzianej w § 2 jest niedopuszczalne.

Artykuł 59 Właściwość organu

§ 1. O przywróceniu terminu postanawia właściwy w sprawie organ administracji publicznej. Od postanowienia o odmowie przywrócenia terminu służy zażalenie.

§ 2. O przywróceniu terminu do wniesienia odwołania lub zażalenia postanawia ostatecznie organ właściwy do rozpatrzenia odwołania lub zażalenia.

Artykuł 60 Wstrzymanie wykonania

Przed rozpatrzeniem prośby o przywrócenie terminu do wniesienia odwołania lub zażalenia organ administracji publicznej na żądanie strony może wstrzymać wykonanie decyzji lub postanowienia.

Wstęp
